Flynn Nutrition:
Terms and Conditions:
Last updated: 31 August 2026
These Terms and Conditions explain the terms on which you may use the Flynn Nutrition website and, where applicable, purchase or receive services from Flynn Nutrition.
Please read them carefully before using our website or booking a service.
By booking or purchasing a service from Flynn Nutrition, you agree to these Terms and Conditions.
Your statutory rights as a consumer are not affected.
1. About Flynn Nutrition:
The website www.flynn-nutrition.com (“our Site”) is operated by:
Flynn Nutrition
Legal entity:Flynn Sport Nutrition and Dietetics LTD
Trading address: 55 Graigola Road, SA7 9HS
Company number: 17484623
Email: contact@flynn-nutrition.com
Our dietetic services are provided by appropriately qualified and HCPC-registered dietitians.
References in these Terms to “Flynn Nutrition”, “we”, “us” or “our” mean the person or legal entity operating Flynn Nutrition as identified above.
2. When these Terms apply:
These Terms apply to:
-
your use of our Site;
-
enquiries made to Flynn Nutrition;
-
appointments booked with us;
-
face-to-face and remote consultations;
-
dietetic and nutrition services purchased from us; and
-
any other services expressly stated to be provided subject to these Terms.
Some individual services, packages, programmes or products may have additional terms. Where this is the case, these will be brought to your attention before purchase.
If there is an inconsistency between these Terms and specific written terms given to you for a particular service, the specific terms will take priority in relation to that service.
3. Our Privacy Policy:
Our Privacy Policy explains how Flynn Nutrition collects, uses, stores and shares personal information, including health information.
Use of personal information is governed by our Privacy Policy and applicable data protection law.
Acceptance of these Terms does not mean that you are giving blanket consent to the processing of your personal information. Flynn Nutrition will process personal information using the appropriate lawful bases described in our Privacy Policy.
Where we specifically rely upon your consent for an optional activity, we will request that consent separately where required.
PART A – DIETETIC AND NUTRITION SERVICES:
4. Our services
Flynn Nutrition provides professional dietetic and nutrition services which may include:
-
dietetic consultations;
-
nutritional assessment;
-
personalised dietary advice;
-
nutrition care planning;
-
meal-planning support;
-
review and follow-up consultations;
-
sports and performance nutrition services;
-
anthropometric assessment, including ISAK Level 1 measurements where appropriate and available; and
-
other nutrition-related services described on our Site or agreed with you.
The exact service provided will depend upon the service booked and your individual circumstances.
Certain services may only be available face-to-face. For example, anthropometric measurements cannot be undertaken during an exclusively remote consultation.
5. Nature of our clinical services:
Dietitians are regulated healthcare professionals.
Advice provided during an individual dietetic consultation is therefore different from the general information published on our website or social-media channels.
Our dietitians will exercise appropriate professional judgement and provide services with reasonable care and skill.
Dietetic treatment may form part of your wider healthcare and does not necessarily replace assessment, diagnosis, medication or treatment provided by your GP, consultant or other healthcare professional.
Where we believe that a matter falls outside our professional scope, requires medical investigation or requires input from another professional or service, we may recommend that you seek appropriate additional healthcare.
We do not guarantee that any particular dietetic intervention will achieve a specific clinical, weight, performance or other outcome.
Responses to nutritional treatment vary between individuals and can be affected by many factors outside Flynn Nutrition's control.
6. Clinical suitability and our right to decline or discontinue care:
We may decide that Flynn Nutrition is not the most appropriate service for you.
This may occur where, for example:
-
your needs fall outside the competence or scope of the practitioner;
-
your condition requires medical assessment or a different level of clinical care;
-
it would not be safe or clinically appropriate to continue treatment through our service;
-
a significant conflict of interest exists;
-
we are unable to establish an appropriate therapeutic or professional relationship; or
-
continuing the service would conflict with our legal, professional or regulatory responsibilities.
Where reasonably possible, we will explain this to you and, where appropriate, suggest that you contact your GP or another suitable healthcare service.
Nothing in these Terms requires a Flynn Nutrition practitioner to provide treatment that they consider clinically inappropriate, unsafe or outside their professional scope.
7. Your responsibilities as a client:
Safe and effective dietetic care depends upon having appropriate information.
You should therefore provide information that is accurate and complete to the best of your knowledge, including relevant information about your:
-
medical history;
-
diagnoses;
-
symptoms;
-
medications and supplements;
-
allergies and intolerances;
-
investigations and blood results where relevant;
-
dietary intake;
-
relevant changes in health; and
-
other treatment or healthcare relevant to your dietetic care.
Please tell us if there is a significant change in your health, medication or treatment that may affect our recommendations.
You remain in control of decisions about your care. Dietetic recommendations will be discussed with you, and you should tell your dietitian if you have concerns about, or difficulty implementing, any recommendation.
We are not responsible for consequences that arise directly from material information being deliberately withheld or materially inaccurate information being provided to us, to the extent that it was reasonable for us to rely upon the information supplied.
This does not reduce Flynn Nutrition's responsibility to provide services with reasonable care and skill.
8. Medical emergencies and urgent care:
Flynn Nutrition is not an emergency medical service and does not provide continuous or 24-hour clinical monitoring.
Do not use email, website forms, social media or routine Flynn Nutrition messaging channels to seek emergency medical assistance.
If you believe that you or another person is experiencing a medical emergency or is at immediate risk of serious harm, call 999 or attend the nearest Emergency Department.
For urgent healthcare advice that is not an emergency, contact your GP, NHS 111 or the appropriate local NHS service.
9. Booking an appointment:
An appointment is not confirmed until:
-
the booking has been accepted by Flynn Nutrition; and
-
any payment required at the time of booking has been received or alternative payment arrangements have been agreed.
We will provide you with information about the service and applicable fee before you are committed to the booking.
Please check the booking confirmation and contact us promptly if any details are incorrect.
10. Fees and payment:
The price of a consultation or service will be displayed or communicated to you before booking.
Unless otherwise agreed:
-
payment is due at the time of booking; or
-
payment must be made in accordance with an agreed invoice or payment arrangement.
Where treatment is being funded by an insurer, employer, sporting organisation or another third party, you remain responsible for ensuring that appropriate funding or authorisation is in place unless Flynn Nutrition has expressly agreed otherwise.
If an insurer or other funder declines payment for a service that you have received, responsibility for the outstanding fee will depend upon the payment arrangements agreed with you before treatment.
We will not introduce additional charges without informing you where required.
11. Your statutory right to cancel an online or distance booking:
Where you are a consumer and enter into an eligible contract with Flynn Nutrition online, by telephone or by another distance method, you may have a statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel the contract without giving a reason.
For a service contract, the normal cancellation period ends 14 days after the day on which the contract is entered into.
Appointments taking place within the 14-day cancellation period
You may wish to receive a consultation before that statutory cancellation period has expired.
Where required, we will ask you to expressly request that Flynn Nutrition begins providing the service during the 14-day cancellation period.
If you subsequently exercise your statutory cancellation right after we have begun providing the service following such a request, you may be required to pay a proportionate amount for services already provided, as permitted by law.
Where the service has been fully performed during the cancellation period following your express request to begin the service and your acknowledgement that your cancellation right will be lost once the service has been fully performed, your statutory right to cancel that completed service will end.
Nothing in this section affects any separate rights you may have under the Consumer Rights Act 2015 where a service has not been provided with reasonable care and skill or otherwise does not conform to the contract.
12. Appointment cancellation and rescheduling policy:
Our statutory cancellation provisions above are separate from our routine appointment cancellation policy.
If you need to cancel or rearrange an appointment, please give us at least 24 hours' notice.
Where at least 24 hours' notice is provided, you may normally:
-
reschedule the appointment without a cancellation charge; or
-
receive any refund that is due for that appointment, subject to any specific package terms and your statutory rights.
Where less than 24 hours' notice is given, or you do not attend an appointment without notice, Flynn Nutrition may charge a cancellation fee of up to the full appointment fee.
Any cancellation charge will be applied fairly and proportionately, taking account where appropriate of matters such as the notice provided, whether the appointment could reasonably be offered to another client and the loss actually incurred by Flynn Nutrition.
We recognise that genuine emergencies and exceptional circumstances occur and may waive a cancellation charge at our discretion.
Repeated late cancellations or non-attendance may result in Flynn Nutrition deciding that we are unable to offer further appointments.
13. If Flynn Nutrition cancels an appointment:
Occasionally, we may need to cancel or rearrange an appointment because of practitioner illness, emergency, technical failure or another circumstance outside our reasonable control.
Where this happens, we will make reasonable efforts to give you as much notice as possible and will offer either:
-
an alternative appointment; or
-
a refund for the affected appointment where you have already paid and do not wish to rearrange.
Flynn Nutrition will not charge you a cancellation fee where we cancel the appointment.
We will not be responsible for additional expenditure that you choose to incur in connection with an appointment unless liability for that expenditure cannot lawfully be excluded.
14. Refunds:
Nothing in these Terms limits your statutory consumer rights.
Where you have paid for a service that Flynn Nutrition cannot provide, you will be entitled to an appropriate refund.
Where a prepaid package or programme is cancelled before all services have been provided, any refund will depend upon:
-
services already provided;
-
applicable statutory cancellation rights;
-
any reasonable loss resulting from the cancellation; and
-
any specific package terms disclosed before purchase.
We will not impose a blanket “no refunds” rule where doing so would conflict with your statutory rights.
If you believe that a service has not been provided as agreed, please contact us so that we can investigate and, where appropriate, offer a suitable remedy.
15. Remote consultations:
Where a consultation takes place by video, telephone or another remote method:
-
you are responsible for having a suitable device and internet or telephone connection;
-
you should, where reasonably possible, participate from a private and appropriate location;
-
you should tell your dietitian if another person is present during the consultation; and
-
you should not record a consultation without first obtaining the agreement of everyone involved.
We will take reasonable steps to maintain confidentiality when providing remote care.
If technical problems prevent a consultation from taking place properly, we will agree an appropriate way forward, which may include restarting, rearranging or completing the consultation by another suitable method.
16. Children and young people:
Where services are provided to a child or young person, Flynn Nutrition will consider issues of:
-
consent;
-
capacity or competence;
-
parental responsibility;
-
confidentiality;
-
safeguarding; and
-
the child's or young person's best interests
in accordance with applicable law and professional standards.
A parent or guardian booking an appointment does not automatically have an unrestricted right to all confidential information disclosed by a competent young person.
Where appropriate, we will explain confidentiality arrangements at the beginning of care.
17. Confidentiality:
Our dietitians are subject to professional duties of confidentiality.
We will treat information about you as confidential and will only disclose confidential information where there is an appropriate basis for doing so.
This may include situations where:
-
you have given appropriate permission;
-
sharing is necessary and appropriate for your healthcare;
-
the law allows or requires disclosure;
-
disclosure is necessary to safeguard you or another person;
-
disclosure is in your best interests in circumstances where you cannot make the relevant decision; or
-
disclosure is justified in the public interest, including where necessary to prevent serious harm.
Data protection and confidentiality are related but separate legal obligations. Further information about how we process personal data is contained in our Privacy Policy.
18. Communication with other healthcare professionals:
Where appropriate to your care, we may recommend communicating with your GP, consultant or another healthcare professional.
Relevant clinical information may be shared where there is an appropriate legal and professional basis for doing so.
Where possible and appropriate, we will discuss planned clinical communication with you.
There may nevertheless be circumstances in which we have a professional or legal obligation to share information without prior agreement, including safeguarding concerns, significant risk of serious harm or where disclosure is required by law.
19. Third-party funded care:
Where your appointments are funded or arranged by an employer, insurer, sports club, educational institution or another organisation, that organisation does not automatically obtain unrestricted access to your clinical information.
Before treatment begins, we will endeavour to make clear:
-
who is responsible for payment;
-
what information the funding or referring organisation expects to receive; and
-
how confidentiality will operate.
Clinical information will only be disclosed in accordance with applicable confidentiality and data protection requirements.
20. Results and outcomes:
Nutrition and healthcare outcomes vary between individuals.
Factors affecting outcomes may include:
-
underlying medical conditions;
-
individual physiology;
-
medication;
-
lifestyle;
-
implementation of agreed recommendations;
-
psychological and social circumstances;
-
sporting or training demands; and
-
factors outside either party's control.
Accordingly, Flynn Nutrition cannot guarantee any particular:
-
weight change;
-
symptom improvement;
-
sporting performance;
-
laboratory result;
-
fertility outcome;
-
gastrointestinal outcome; or
-
other clinical result.
This does not affect our obligation to provide services with reasonable care and skill.
21. Complaints and concerns:
We want concerns about our services to be addressed promptly and fairly.
If you are unhappy with any aspect of Flynn Nutrition's service, please contact:
Email: contact@flynn-nutrition.com
Please provide sufficient information for us to understand and investigate the issue.
We will endeavour to acknowledge and respond to complaints within reasonable timescales.
Nothing in this complaints procedure affects any statutory rights or any right you may have to raise a concern with an appropriate professional, regulatory or legal body.
PART B – USE OF OUR WEBSITE:
22. Access to our Site:
Our Site is made available free of charge.
We do not guarantee that the Site or any particular content will always be available or uninterrupted.
We may suspend, withdraw, restrict or change all or part of the Site for business, operational, security or other reasonable reasons.
You are responsible for ensuring that anyone accessing our Site through your internet connection is aware of these Terms where appropriate.
23. General website information is not individual clinical advice:
Information published on our Site, blog or social-media channels is provided for general information and education.
It is not based upon an individual assessment of your health and should not be treated as personalised dietetic or medical advice.
Do not delay obtaining appropriate medical assessment or treatment because of general information you have read on our Site.
Where you receive an individual consultation from one of our dietitians, the personalised clinical advice given during that professional relationship is subject to the provisions in Part A of these Terms.
24. Accuracy of website content:
We take reasonable care when preparing information published on our Site.
However, nutrition and healthcare evidence, professional guidance and clinical recommendations can change over time.
We do not guarantee that every general-information page will remain completely current at all times.
We may update, amend or remove website content without notice.
If you believe information published on our Site is inaccurate, please contact us.
25. Intellectual property:
Unless otherwise stated, Flynn Nutrition is the owner or authorised licensee of the intellectual property rights in our Site and the original material published on it.
Those works are protected by copyright and other intellectual property laws.
You may:
-
view our website for personal use;
-

-
share links directing other people to publicly available pages on our Site.
You must not, without prior written permission:
-
substantially reproduce our materials;
-
modify and republish our materials as your own;
-
sell or commercially exploit our website content;
-
remove copyright or authorship notices;
-
use our photographs, illustrations or graphics separately in a misleading manner; or
-
represent Flynn Nutrition content as having been created or endorsed by you.
Nothing in these Terms prevents any use permitted by law.
26. Linking to our Site:
You may link to publicly accessible pages on our Site provided that you do so fairly and lawfully.
You must not link to our Site in a way that:
-
damages our reputation;
-
falsely suggests an association, partnership, approval or endorsement; or
-
is otherwise unlawful or misleading.
We may ask you to remove a link where we reasonably believe these requirements have been breached.
27. Links to third-party websites:
Our Site may contain links to third-party websites or services.
Such links are provided for convenience or information and do not necessarily amount to Flynn Nutrition endorsing the third party or everything published on that website.
We do not control independent third-party websites and are not responsible for their content, availability or privacy practices.
28. Viruses, security and misuse of our Site:
We take reasonable measures to operate our Site securely but cannot guarantee that it will always be completely free from bugs, viruses or other malicious material.
You are responsible for using appropriate security and virus-protection measures on your own devices.
You must not knowingly:
-
introduce viruses, trojans, worms, logic bombs or other malicious material;
-
attempt to gain unauthorised access to our Site or systems;
-
attack our Site using a denial-of-service or distributed denial-of-service attack;
-
interfere with the proper functioning of the Site; or
-
use our Site for an unlawful purpose.
Conduct of this nature may constitute a criminal offence under the Computer Misuse Act 1990.
Where appropriate, we may report suspected criminal activity to law-enforcement authorities.
PART C – LIABILITY AND GENERAL LEGAL TERMS:
29. Our responsibility to consumers:
Nothing in these Terms excludes or restricts any responsibility that Flynn Nutrition cannot lawfully exclude or restrict.
In particular, nothing excludes or limits liability for:
-
death or personal injury caused by our negligence;
-
fraud or fraudulent misrepresentation; or
-
any other liability that cannot lawfully be excluded.
If you are a consumer, Flynn Nutrition is required to provide services with reasonable care and skill.
Nothing in these Terms removes or restricts your statutory rights under the Consumer Rights Act 2015 or other applicable consumer legislation.
30. Matters outside our responsibility:
Subject to section 29, Flynn Nutrition will not be responsible for loss or harm to the extent that it results from:
-
materially inaccurate information supplied to us where it was reasonable for us to rely upon it;
-
material information being withheld from us;
-
a significant change in your health or medication of which we could not reasonably have been aware;
-
use of general website information as though it were personalised clinical advice;
-
unauthorised alteration of a dietetic plan or resource supplied by Flynn Nutrition;
-
acts or omissions of an independent third party outside our reasonable control; or
-
circumstances that we could not reasonably have avoided.
Nothing in this section excuses Flynn Nutrition from exercising reasonable professional care and skill.
31. Business users:
If you use our Site wholly or mainly for purposes relating to your trade, business, craft or profession, you are a business user rather than a consumer for that use.
To the extent permitted by law, Flynn Nutrition will not be liable to a business user for:
-
loss of profits;
-
loss of sales or revenue;
-
business interruption;
-
loss of anticipated savings;
-
loss of business opportunity;
-
loss of goodwill or reputation; or
-
indirect or consequential commercial loss.
This section does not apply to individual consumers receiving dietetic care for purposes mainly outside their business or profession.
32. Events outside our reasonable control:
Neither you nor Flynn Nutrition will be treated as being in breach of these Terms where performance is prevented or materially delayed by circumstances beyond reasonable control.
This may include, where relevant:
-
serious illness;
-
emergency;
-
major internet or telecommunications failure;
-
widespread power failure;
-
natural disaster;
-
fire or flooding;
-
government restrictions; or
-
another comparable event outside reasonable control.
Where such an event affects an appointment, we will make reasonable efforts to rearrange the service or provide an appropriate refund where required.
33. Changes to these Terms:
We may amend these Terms from time to time to reflect:
-
changes in law or regulation;
-
professional requirements;
-
changes to our services;
-
changes to our systems or business practices; or
-
clarification of existing terms.
The latest version will be published on our Site.
Changes will not retrospectively remove rights you have already acquired under an existing contract.
Where a material change affects an ongoing service or package, we will provide appropriate information where required.
34. If part of these Terms is invalid:
Each provision of these Terms operates separately.
If a court or other competent authority decides that any provision is unlawful or unenforceable, the remaining provisions will continue to apply.
35. No waiver:
If Flynn Nutrition does not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
36. Third-party rights:
Unless expressly stated otherwise, these Terms are between you and Flynn Nutrition.
No other person has a right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999, except where the law provides otherwise.
37. Governing law and jurisdiction:
These Terms and any contract between you and Flynn Nutrition are governed by the law of England and Wales, subject to any mandatory consumer protections that apply to you.
If you are a consumer:
-
if you live in England or Wales, proceedings may be brought in the courts of England and Wales;
-
if you live in Scotland, proceedings may generally be brought in Scotland or England and Wales as permitted by law; and
-
if you live in Northern Ireland, proceedings may generally be brought in Northern Ireland or England and Wales as permitted by law.
Nothing in these Terms deprives you of mandatory consumer protection available under the law applicable to you.
